Kramer Alberti Records Clean Sweep, Wins Five Consecutive IPRs for Client ASSIA

May 23, 2025

Kramer Alberti recorded a clean sweep for client Adaptive Spectrum and Signal Alignment, Inc. (“ASSIA”), winning denial of institution of all five inter partes review petitions (“IPRs”) filed by Charter Communications’ challenges of the validity of ASSIA’s foundational patents. The IPRs are captioned in the Patent Office PTAB as Charter Communications, Inc. v. Adaptive Spectrum and Signal Alignment, Inc.

ASSIA’s patents are directed to innovative techniques for improving digital communications systems performance. ASSIA, led by inventor, Dr. John M. Cioffi, is known as a pioneer in innovation developing core technologies for Internet access and optimization. Dr. Cioffi is a Professor Emeritus at Stanford University and received, among many other accolades, the National Medal of Technology and Innovation, awarded by the President of the United States “for advancements that helped bring high-speed Internet to the world.”

“ASSIA is protecting its valuable patented technologies against infringement. And to do so, it had to file a five-patent case in the U.S. District Court, which we are vigorously litigating against Charter Communications. In these important decisions, the PTAB has now denied all five of Charter’s IPRs in which it challenged the validity of ASSIA’s five foundational patents. This sweep, with our team running the table on behalf of ASSIA against Charter, is remarkable,” stated Kramer Alberti partner and lead counsel for ASSIA, Rob Kramer.

“We are very happy for ASSIA, and we’ll now head to trial in the district court in Texas this fall,” explained Kramer Alberti partner, Nicole Glauser, who also heads the firm’s Austin office. “Winning all five IPR victories is quite an accomplishment, and we’re very happy for John [Cioffi] and the team at ASSIA,” added partner David Alberti.

To secure the IPR victories for ASSIA , Kramer Alberti co-counseled in the PTAB with attorneys from Sterne, Kessler, Goldstein & Fox, PLLC, with whom they have a strong relationship.  Opposing counsel representing Charter Communications in the district court case and related IPRs are Quinn Emanuel Urquhart & Sullivan, LLP, Greenberg Traurig, LLP, and Proskauer Rose LLP.
