Kramer Alberti Secures Additional Courtroom Victories for Client Adaptive Spectrum and Signal Alignment, Inc. (ASSIA)

May 1, 2025

Kramer Alberti obtained a consecutive trio of significant IPR wins for client and patent owner Adaptive Spectrum and Signal Alignment, Inc. (“ASSIA”) with the PTAB denying institution of three inter partes review petitions filed by Charter Communications challenging the validity of ASSIA’s patents. The IPRs are PTAB IPR2024-01379, IPR2025-00013, and IPR2025-00012, Charter Communications, Inc. v. Adaptive Spectrum and Signal Alignment, Inc.

ASSIA’s patents are directed to innovative techniques for improving digital communications systems performance. ASSIA, led by inventor, Dr. John M. Cioffi, is known as a pioneer in innovation developing core technologies for Internet access and optimization. Dr. Cioffi is a Professor Emeritus at Stanford University and received, among many other accolades, the National Medal of Technology and Innovation, awarded by the President of the United States “for advancements that helped bring high-speed Internet to the world.”

“We are proud that the firm achieved this terrific and rare result for ASSIA, winning denial of institution of three consecutive IPRs filed by Charter Communications,” stated Kramer Alberti partner and lead counsel for ASSIA, Rob Kramer.

“ASSIA is in the process of proving that Charter infringes these three, plus two more, of ASSIA’s patents in the U.S. District Court in Marshall, Texas. We are expecting a decision in Charter’s remaining two IPRs in the coming weeks as we head towards trial in the district court this fall,” explained Nicole Glauser, a Kramer Alberti partner, who also heads the firm’s Austin office.

“Winning three IPR victories in a row for ASSIA is a great accomplishment, achieved by working with co-counsel, John, and the team at ASSIA,” added partner David Alberti.

To secure the IPR victories for ASSIA , the Kramer Alberti team co-counseled in the PTAB with attorneys from Sterne, Kessler, Goldstein & Fox, PLLC, with whom they have a strong relationship.  Opposing counsel representing Charter Communications in the district court case against ASSIA, and related IPR, are Quinn Emanuel Urquhart & Sullivan, LLP, Greenberg Traurig, LLP,  and Proskauer Rose LLP.
