Kramer Alberti Secures Important Appeals Win for The University of Michigan in Patent Infringement Case

Kramer Alberti secured an important and strategic appeals win yesterday for its client The University of Michigan (U of M) in the U.S. Court of Appeals for the Federal Circuit. The federal appeals court unanimously upheld the validity of all claims of The University of Michigan’s valuable and foundational white light laser microscope technology patent, as reported in the press, including in an article published in Law360.

“The PTAB carefully considered Leica’s arguments and issued a lengthy, well-reasoned decision concluding that The University of Michigan’s 169 patent is valid after a full PTAB trial. We are pleased that the Federal Circuit has reaffirmed the validity of UM’s patent in this decision,” explained Kramer Alberti partner Robert Kramer, lead counsel for The University of Michigan.  “Leica will be estopped from re-litigating the validity of U of M’s patent, and we expect this will streamline a resolution of U of M’s patent infringement case against Leica as it now proceeds in the district court,” added partner Russell Tonkovich, who led the firm’s effort to win the IPR in the PTAB and the appeal in the Federal Circuit.

The case is The University of Michigan v. Leica Microsystems.  Leica filed this appeal in the Federal Circuit after Kramer Alberti successfully defended the university in an inter partes review (“IPR”) that Leica filed challenging the validity of the university’s patent.  The university’s patent infringement case, University of Michigan v. Leica Microsystems, will now resume in the U.S. District Court for the Northern District of California to address Leica’s infringement of the university’s valuable patented technology.
