Hong S. Lin

Attorney

Hong focuses his practice on intellectual property litigation in district court and at the International Trade Commission. He has managed and worked on highly complex cases involving a myriad of technological areas, including semiconductor packaging, Wi-Fi and cellular communications, smartphones, flash memory, computer security, computer networking, data compression, interactive television and content delivery, among others.

Hong has experience in all phases of patent litigation, including conducting due diligence of patent portfolios for acquisition, arguing at Markman hearings, taking and defending fact and expert witness depositions, and examining witnesses at trial. Hong also has recent experience at the Patent Trial and Appeal Board.

Hong has over 20 years of experience in IP. Prior to joining Kramer Alberti, Hong worked in the IP litigation groups of two prominent international law firms as partner, of counsel, and associate.  While attending law school, Hong worked full-time as a patent agent to prepare and prosecute patent applications in the U.S. and abroad.

Broadband iTV, Inc. v. AT&T, DirecTV, Dish Network LLC (W.D. Texas)  Represented plaintiff BBiTV in a case involving video-on-demand technology. Obtained a favorable settlement prior to summary judgment.
OpenTV, Inc. v. NFL Enterprises, LLC. (C.D. Cal)  Represented OpenTV in a case involving streaming technologies. Obtained favorable settlement.
Sycamore IP Holdings v. ADVA (E.D. Tex.) Defended ADVA in a case relating to coding schemes for optical communication systems and secured a favorable settlement following claim construction.
In re Certain Products Containing Interactive Program Guide and Parental Controls Technology (ITC) Represented complainant Rovi in a matter against LG and others involving program guides and parental controls. Obtained a favorable settlement.
Nokia v. HTC (ITC and D. Del.)  Defended HTC in multiple patent cases brought by Nokia related to various aspects of handset technology. Case settled favorably.
MobileMedia Ideas v. HTC (E.D. Tex.) Defended HTC in a patent case brought by MMI related to various aspects of handset technology. Case settled favorably just prior to commencement of trial.
In re Certain Products Containing Interactive Program Guide and Parental Controls Technology (ITC) Represented complainant Rovi in a matter against Sharp involving program guides and parental controls. Obtained a favorable settlement at an early stage in the investigation.
In re Certain Products Containing Interactive Program Guide and Parental Controls Technology (ITC) Represented complainant Rovi in a matter against Toshiba involving program guides and parental controls. After a successful Markman argument, obtained a favorable settlement on behalf of Rovi that resolved multiple lawsuits filed against Toshiba.
Tec Sec, Inc. v. IBM, et al. (E.D. VA) Represented Sybase in a patent infringement case involving encryption software methods and products.
Realtime v. Packeteer, et al. (E.D. Tex.) Defended Blue Coat and Packeteer in patent case involving data compression technology. Obtained favorable settlement just prior to commencement of trial.
Telecommunications Systems v. Sybase, et al. (E.D. VA and D. Del.) Represented Sybase in parallel cases involving software patents related to location-based services for tracking mobile devices and obtained a favorable settlement after securing positive claim construction rulings.
Sybase v. Telecommunications Systems (E.D. VA) Represented Sybase in a case relating to enterprise software and obtained a favorable settlement following claim construction.
In re Certain Semiconductor Chips with Minimized Chip Package Size and Products Containing Same and Tessera v. Qualcomm, et al. (ITC and N.D. Cal.) Represented Qualcomm in multiple actions brought by Tessera relating to semiconductor packaging. Case settled favorably after the court-appointed expert agreed with Qualcomm’s non-infringement positions.
